By using Racks, you agree to these terms. Please read them carefully.

Use of the App

You may use Racks for personal, non-commercial purposes in accordance with these terms.

Accounts

You must sign in to contribute to Racks. You are responsible for all activity that occurs under your account. On first sign-in you are assigned a randomly generated username, which you can edit in the app.

User-Submitted Data

Racks is a community-sourced database. Rack locations, photos, and associated information are submitted by users and may not always be accurate, current, or complete. While we do our best to maintain data quality and rely on user reports to identify and correct issues, all rack information should be treated as an indication only.

We make no guarantees about the accuracy, completeness, or reliability of any rack data, and we are not responsible for any loss, injury, or inconvenience arising from reliance on information in the app.

If you believe a rack entry is incorrect, please use the in-app reporting tool to flag it for review.

Your Submissions

When you submit a rack, photo, or other content through Racks, you grant us a non-exclusive, worldwide, royalty-free licence to store, display, and distribute that content to other users of the app and via the Racks API. You retain ownership of content you submit, but by submitting it you confirm that you have the right to do so and that it does not infringe the rights of others.

You are responsible for the accuracy and appropriateness of content you submit. Deliberately submitting false, misleading, or malicious information is a violation of these terms.

Acceptable Use

You agree not to:

• Submit false, misleading, or fabricated rack information
• Upload photos that are irrelevant, offensive, or abusive
• Attempt to manipulate the app, its data, or other users
• Use the app in any way that violates applicable law or the rights of others

Enforcement and Account Termination

We do not tolerate abuse of the Racks platform. We reserve the right to remove content, suspend, or permanently ban accounts that violate these terms, at our sole discretion and without notice. This includes submitting false data, uploading inappropriate content, using an offensive username, or attempting to manipulate or disrupt the service.

We reserve the right to report serious abuse including harassment, threats, or illegal activity to the relevant authorities.

OpenStreetMap Data

Some rack data within the app is sourced from OpenStreetMap and is made available under the Open Data Commons Open Database License (ODbL). User contributions to OpenStreetMap-sourced racks are also made available via the Racks API in compliance with this licence.

If you use data from the Racks API, you are free to copy, distribute, transmit, and adapt it, as long as you credit Malurus Softworks (us), OpenStreetMap and its contributors. If you alter or build upon the data, you may distribute the result only under the same licence.

Intellectual Property

All content, trademarks, and software in Racks are owned by or licensed to us. You may not copy, modify, or distribute them without our permission.

Disclaimer of Warranties

Racks is provided "as is" without warranty of any kind. We do not guarantee that the app will be uninterrupted, error-free, or meet your specific requirements.

Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages arising from your use of Racks, including any reliance on rack data provided in the app.

Changes to These Terms

We may update these terms from time to time. Continued use of the app after changes constitutes acceptance of the updated terms.

Governing Law

These terms are governed by the laws of Australia.
